Amber PortwoodReality-show starlet Amber Portwood, whose legal woes began on MTV’s Teen Mom, will be in an Indiana prison for at least the next two years.

Judge David Happe ruled yesterday that the Teen Mom star must serve the prison time he imposed earlier this year when she pleaded guilty to a felony drug charge. She had thus far managed to avoid prison with a plea deal that included drug rehab, but she dropped out of rehab in May.

Portwood, 22, was arrested on May 24 for violating her court probation requirements by failing a urine test and then lying about it, according to Prosecuting Attorney Rodney Cummings.

That violation in and of itself may not have caused her probation to be revoked, “but she just opted out,” Cummings said. “I just don’t think she knew opting out meant five years in prison.”

Portwood will probably spend 2.5 years in prison before being released on parole for the remainder of the five years, Cummings said. Inmates get one day taken off of their prison time for each day successfully served. It’s possible she could get another 30-day reduction for completing a drug rehab program while in prison, as well.

It will likely take about two weeks before the commitment order is signed by the judge and Portwood gets moved from the Madison County jail to state corrections department custody.

Portwood was initially taken into custody on felony domestic violence charges in November 2010 due to incidents seen on Teen Mom – where she had been shown shoving, punching, and slapping boyfriend, Gary Shirley.

Last year, Portwood was offered $500,000 to do a porn film and also had to be hospitalized after a failed suicide attempt.

The Teen Mom star was again arrested in December of last year when a probation search found “a fairly sufficient amount of several different prescription pills” that were not prescribed to her, Cummings said.

She spent over one month in jail before reaching a plea deal that included the drug rehab program.

Her 3-year-old daughter is in the custody of Shirley, the girl’s father.
