A federal judge has dismissed the lawsuit filed by April Mogolon, who claimed that Donald Duck groped her breast during a 2008 visit to Epcot.
According to Magolon, the groping incident occurred in May 2008 while she was vacationing at Epcot Center with her fiancee and young children.
She alleged that when she approached the Donald Duck character for an autograph, he grabbed her breast and molested her.
Magolon, 28, filed suit against Walt Disney Parks and Resorts LLC, claiming the alleged incident has caused her to suffer post-traumatic stress disorder (PTSD), flashbacks, nausea, cold sweats, insomnia, nightmares and digestive problems. In the lawsuit, she states that she thinks her injuries are permanent.
She was suing for negligence, negligent infliction of emotional distress, battery and intentional/reckless infliction of emotional distress. She had been seeking damages in excess of $50,000 “plus delay damages, punitive damages, costs, interest and other damages permitted by law.”
The man in the Donald Duck costume was eventually criminally charged, but later acquitted.
On Thursday, a judge signed an order dismissing the case, with prejudice, according to court filings. The order prevents April Magolon from filing another case on the same claim.
